VIZSAFE DISCLAIMER AGREEMENT

By using the Vizsafe and Geoaware® applications (“App”, “Website” , “Site" , "Geoaware Network" , "Geoaware Command" , "Geoaware Access" , “Services” or “VIZSAFE.com”), you understand and agree to these terms.

WARNING - NOT FOR MEDICAL USE

The Vizsafe Geoaware® Access Kiosk and Apps (the  "Kiosk" or "App") are not intended to diagnose, mitigate, prevent, or treat any medical condition. Measurements and any data provided by the App is intended for informational purposes ONLY and should never be considered a replacement for professional medical care. The App has not been tested with individuals with health conditions and, if knowing the information measured by the App is critical to your health, you should consult a healthcare professional. The App has not been reviewed or approved by the U.S. Food and Drug Administration (FDA).

1. You have read and agree to the “Terms of Use”, “Privacy Policy” and “Rules of Conduct”

2. Your use of the Services is at your sole risk.  Location data, safety and crime data, and any other information or data may not be accurate.

3. Always dial 911 in the event of an emergency.  Always make sure you are in a safe place before reporting.  Sending reports while driving a vehicle is strictly prohibited.

4. You are responsible for your use of the Services, for any Content you post to the Services, and for any consequences thereof. The Content you submit, post, or display will be able to be viewed by other authorized users of the Services licensed by the company who granted you access as a user.  You should only provide Content that you are comfortable sharing with others under these Terms.

5. Vizsafe Geoaware applications are a product and service of Vizsafe, Inc.  Vizsafe, Inc. or its employees, partners, agents, affiliates, directors, shareholders, advisors, investors, or anyone on its behalf shall have no liability nor responsibility to any person or entity with respect to any part of the application including but not limited to downloading, use, reporting, connectivity, messaging, and expectations of this application, and they shall not be liable to you or to any third party, for any reason whatsoever, as a result with use of the Vizsafe products or services including the mobile apps.  You hereby irrevocably release all of the above from any liability of any kind, for any consequence arising from use of the Vizsafe Products or Services, including any loss, direct or indirect, financial or non-financial.

6. Due to the nature of the Internet and mobile SMS delivery networks, Vizsafe does not guarantee security or timely delivery or reception of any submitted information including posts, reports, messaging, notifications, and all other submitted data. Neither Vizsafe nor its participating affiliates or partners makes any guarantee as to if, how, or when any submitted information and data may or may not be acted upon.

7. Any misuse or abuse of the Vizsafe Services, website and mobile application is strictly prohibited.  Please refer to the Vizsafe “Rules of Conduct” for additional guidelines.
